Veteran Aid & Attendance Eligibility
The Department of Veteran Affairs (VA) reviews the following four areas to determine eligibility:
1. MILITARY SERVICES
Veteran must have served a minimum of 90 days of active duty. One of those days must be during a period of war:
- World War I: April 6, 1917, through 11/11/1918
- World War II: 12/7/1941 through 12/31/1946
- Korean War: 6/27/1950 through 1/31/1955
- Vietnam War: 8/5/1964 through 5/7/1975*
- Persian Gulf War: 8/2/1990, through a date to be set by Presidential Proclamation or Law.
The Veteran must have received a discharge from active duty under conditions other than dishonorable.
*February 28, 1961 for veterans who served “in country” before August 5, 1964.
2. HEALTH
The need for assistance with Activities of Daily Living (ADLs) – bathing, dressing, etc. or the claimant is legally blind or nearly blind.
3. INCOME VS MEDICAL EXPENSES
The VA compares the relationship between a claimant’s income (Social Security, pension(s) and all other fixed income) and medical expenses (assisted living, home care, skilled nursing, adult day care, and health insurance premiums). If the claimant spends all of their income on countable medical expenses, they should be entitled to the maximum monthly income from the Department of Veterans Affairs. If the claimant spends a portion of their income on care related medical expenses, they may be eligible for a partial benefit from the Department of Veterans Affairs.
4. SAVINGS/NET WORTH
The VA does not designate a specific dollar amount to determine if someone is eligible for the benefit. The number varies for every person/family who applies. The VA looks at every claim individually and makes a net worth determination based on the facts and circumstances of each case. If there are significant assets, benefits may still be awarded depending on care expenses, however if you are in this situation, please seek the assistance of the Department of Veterans Financial with this issue, prior to proceeding. Any mistake can cost tens of thousands of dollars in benefits.
Aid & Attendance Benefit Application Documents Needed:
- Military separation paper form DD-214. The VA requires a certified copy, or original in most cases. To order a copy from the National Archives visit www.archives.gov/veterans. If you learn that your records were destroyed in the St. Louis fire of 1973, the VA will most likely be able to provide a valid certificate of service, although that may take additional time.
- Married Veterans and surviving spouses will need to provide a copy of the marriage certificate.
- Surviving spouses will need to provide a copy of the Veteran’s death certificate. Current Social Security Award letter showing the monthly amount of incoming Social Security benefit. Additionally, if applicable, a monthly statement from a private pension program is necessary. However, many claims do get approved without these documents.
- Court-appointed guardians of the applicant will need to provide a copy of the court order.
- If your monthly health insurance, home care, assisted living, adult day care, or nursing home bill is paid out of pocket and not reimbursed by a long term care insurance policy or Medicaid, then you will need to provide these statements.
- Physician statement that provides detailed information about your diagnosis, current medical status, prognosis, ability to care for yourself and your need for assistance with Activities of Daily Living (ADLs).
- Voided check for direct deposit of the monthly payment. The benefit is paid directly to the claimant similar to Social Security.
- List of doctors and hospitals utilized in the past 12 months.
